  • Government agencies when required by law or regulation (e.g., FMCSA, DOT)

5. Data Retention

We retain your information for as long as your account is active or as needed to provide the Service. Driver Qualification File (DQF) records are retained in accordance with FMCSA requirements (49 CFR 391.51), which require retention for the duration of employment plus three years after termination.

You may request deletion of your account and associated data by contacting us. Certain data may be retained as required by law or for legitimate business purposes.

8.1 Obligations of Users (Employers/Carriers)

As a user of consumer reports obtained through the Service, you are required to:

  • Certify that you have a permissible purpose under FCRA § 604 for obtaining the report
  • Provide a clear and conspicuous written disclosure to the consumer (applicant) that a consumer report may be obtained, in a document consisting solely of the disclosure
  • Obtain written authorization from the consumer before procuring the report
  • Provide a pre-adverse action notice (including a copy of the report and a summary of rights) before taking adverse action based on the report
  • Provide an adverse action notice after taking adverse action, including the name and contact information of the CRA that furnished the report
  • Not use the information for any purpose other than the permissible purpose for which it was obtained
  • Comply with all applicable federal and state consumer reporting laws

8.2 Consumer Rights

If you are a driver or applicant whose information has been reported through the Service, you have the right to:

  • Request disclosure of the nature and substance of all information in your file
  • Dispute inaccurate or incomplete information
  • Have inaccurate information corrected or deleted
  • Place a fraud alert or security freeze on your file
  • Receive a free copy of your file disclosure once per year upon request
